NBC Sports Coverage

During NBC Sports’s broadcast of the semifinal matches of the PGA Tour Accenture Match Play Championship held at the Ritz-Carlton Golf Club in Arizona on February 28, 2009, Jimmy Roberts hosted a segment on noteworthy golf innovations introduced at the 2009 PGA Merchandise Show. FairwayPro was the first of a handful of new products showcased in this segment. There is no doubt that FairwayPro is one of the most significant golf product introductions in recent years.

Item-by-item Review Of How China Pulled Off The Ripoff

Owner's Experience Could Help You Draw Lessons
  • After prototyping and testing my golf product idea, I applied for and received two US utility patents.
  •  A top engineering team finalized my design and created CAD files used to create the injection mold making tooling needed for manufacturing.
  • The product was tested on a custom endurance hitting machine (video shown below), and was aggressively hit 750,000 times with no damage.
  • FairwayPro was presented at the PGA Merchandising Show and the 100% positive feedback was astounding!
  • Duly inspired, I looked hard at US manufacturers but the costs were prohibitive.
  • With hesitation, I looked into sourcing in the Asia-Pacific area and settled on China.
  • After careful review, I found AVIC International USA. AVIC (https://www.avic.com/en/) is a state-owned conglomerate with businesses in various industries. As it turned out, it had recently ventured into the golf industry and was therefore extremely interested in FairwayPro.
  • AVIC proposed and I agreed to a deal which included assigning AVIC as the sole distributor in China. The product would be manufactured at its AVIC US factories in Shenzhen.
  • What happened next can only be described as manufacturing hell. Units contained in each shipment had new and different defects that required repairs performed at our warehouse.
  • AVIC agreed in writing to reimburse us for the parts and labor. As I believed AVIC had the same motivation to fix the defects once and for all since it was also selling the product in China, I thought, with each shipment, it would be the last time we would have to perform repairs. Each time, I was proven wrong.
  • AVIC kept putting off actually paying for the repairs, stating it would be better for our partnership if AVIC could book continued revenue growth to garner more management support of FairwayPro.
  • In hindsight, it was not inconceivable that AVIC sabotaged the units shipped to us to put us in severe financial difficulty.
  • When we attempted to place our most recent order and demanded the credits be applied, we were ignored.
  • When I contacted AVIC, Mr. Xuming Zhang expressed his surprise.
  • During this time, I came to find out that AVIC was selling FairwayPro around the world.
  • Eventually, AVIC agreed to return the tooling injection molds and pay the cost of setting up the molds here in the US for production.
  • However, when I broached the issue of money owed to us for the repairs, AVIC turned its back on me.
  • Eventually, I was forced to file a lawsuit in the Superior Court of Los Angeles, which I won.
  • AVIC filed an appeal and lost.
  • To this day, our injection molds are still in China, and AVIC is making money while we are stuck with no product to sell. The battle continues.

This incredible product does not belong to China. It was ripped off by China. The California Superior Court Judge agreed in a legal court judgement against AVIC, that the stolen property is my property.
