This website is a personal project. My wife and I run a reputable marketing and PR agency in Los Angeles. Since we are Shell’s primary B2B and PR agency in America, we thought it would benefit us to learn golf. We frequently interact with brand and category managers at Shell and Texaco, and we have found that they love playing golf. Sometimes, they organize corporate in-house tournaments where teaming up is good business.

After securing the account, we decided to enhance our golfing abilities rapidly. We stumbled upon PGA Teaching Pros, enrolled in their lessons, and practiced extensively to play with the oil executives. Unfortunately, both of us got injured in the process. Upon discussing the matter with our Pro, we discovered that the mat we were hitting off was made of nylon turf laminated to a rigid foam mat placed on concrete. We realized that something needed to be changed!

I brainstormed and devised a solution we patented and put on the market. We found AVIC, a Chinese company with a local office in the golf business, who provided the manufacturing at AVIC in China.

The US-based AVIC strategically stole our product, and many others then filed for bankruptcy and got away with it regarding our product!

Here’s how the Chinese government has taken advantage of our free society and used our government systems to get away with robbing us blind.

It is alarming when a state-owned Chinese entity, like AVIC, responsible for aerospace defense development and manufacturing for the Chinese government, engages in intellectual property theft. What’s worse is that AVIC was found guilty and faced a nearly $100 million penalty for IP theft, and even after appealing to the Supreme Court, the verdict was upheld. As a result, AVIC filed for bankruptcy in Los Angeles, California. This website will focus on the ongoing rivalry between the United States of America and China.

Xuming Zhang, the president of AVIC, faced a lawsuit in Dallas, Texas, that lasted for over seven years and resulted in a nearly $100 million theft judgment. During this time, Zhang, representing his Chinese superiors, slowly divested massive assets before ultimately filing for bankruptcy in Los Angeles under Case No.: 2:20-bk-19043-WB Chapter 11.

In this bankruptcy case, the wind and solar creditors received a settlement worth millions from AVIC’s Chinese parent company in China, as AVIC USA claimed to be “penniless.” The bankruptcy judge, Julia W. Brand, allowed this payment to be made directly from the China parent company while disallowing our claim in this bankruptcy case.

AVIC illegally sold FairwayPro on the Asian website TaoBao.com, which is larger than Amazon, for sale all over Asia. This is one of many sales outlets used by AVIC.

Numerous Chinese companies have been accused of stealing trade secrets from various sectors of the American economy, ranging from automobiles, auto tires, and aviation to chemicals, consumer electronics, industrial software, and biotech and pharmaceuticals. For example, U.S. Steel alleged that Chinese hackers had stolen trade secrets related to the production of lightweight steel and passed them on to their Chinese counterparts.

For many years, successive American administrations have acknowledged that some level of exposure to China’s intellectual property violations is an unavoidable aspect of doing business with the world’s second-largest economy. However, this attitude is unacceptable. While China is an important trading partner for the United States, it is crucial to establish a fair and equitable trading environment.

FairwayPro’s patented golf mat has taken to market globally, achieving a 4.5-star rating on Amazon.  This consumer golf product was secretly stolen and sold throughout Asia by AVIC.

The top-rated use it at home or take it to the practice range FairwayPro. The thousands sold this product until it was stolen by AVIC, who refused to supply orders and failed to return the tooling.

FairwayPro was sold nationwide through significant golf retailers, online websites, and distributors worldwide. Here, it is shown at the largest golf retail store in the US.

NEW COMMERCIAL VERSION

After years of legal delay, FairwayPro is back on the move. The new version for golf courses, driving ranges, simulators, and more will be launched in early 2024.
